These Terms and Conditions of Use and Sale (hereinafter the "Terms") govern access to and use of the Velyq platform, available at velyq.com (hereinafter the "Platform" or the "Service"), as well as the sale of subscriptions and services offered on it. They form a contract between you, the user (hereinafter the "User" or "Customer"), and the operator of the Service. By creating an account or placing an order, you acknowledge that you have read and accept these Terms in full.
1. Publisher and Seller
The Service is published and operated by Mathieu Neumar (trading under the "Velyq" brand), a sole trader under the French micro-enterprise regime, SIRET 89349160500026, with registered address at 51 rue du Général Leclerc, 94270 Le Kremlin-Bicêtre, France. VAT not applicable, Article 293 B of the French General Tax Code. Contact: contact@velyq.com. Mathieu Neumar is the Customer's sole point of contact for any matter relating to the Service and the sale of subscriptions.
2. Purpose and Description of the Service
Velyq is an AI-powered job-search assistance platform. The Service notably includes the following features:
- CV analysis and assessment of compatibility with applicant tracking systems (ATS);
- Interview simulation, in text and voice mode;
- Cover letter generation;
- LinkedIn profile optimization;
- Application tracking.
The Service relies on artificial intelligence models provided by third-party providers (including OpenAI, Google, ElevenLabs and Deepgram). Content, analyses, scores and recommendations produced by the AI are provided for indicative and educational purposes only. Velyq does not provide any legal, tax, professional or recruitment advice, and offers no guarantee of being hired, of obtaining an interview, or of any result. The User remains solely responsible for how they use this content and for their job applications.
3. Access to the Service and Account Creation
- Certain features require the creation of a personal account. The User undertakes to provide accurate, up-to-date and complete information when registering, and to update it when necessary.
- The account is strictly personal. The User is responsible for keeping their credentials confidential and for any activity carried out from their account. They must notify Velyq without delay of any unauthorized use.
- The Service is intended for persons aged at least 15. A User under 15 may register only with the consent and under the responsibility of the holder(s) of parental authority.
- Access to the Service requires an Internet connection and compatible equipment, at the User's expense.
4. Prohibited Conduct
When using the Service, the User is notably prohibited from:
- Using the Service for fraudulent, unlawful purposes or purposes contrary to public order and morality;
- Submitting, posting or distributing unlawful, defamatory or hateful content, or content infringing the rights of third parties;
- Automatically extracting, copying or collecting the Platform's data or content (scraping, bots, harvesting);
- Attempting to circumvent quotas, technical limitations or security measures of the Service;
- Sharing, reselling or making their access or account available to third parties;
- Disrupting, overloading or compromising the operation, integrity or security of the Platform.
Any breach may result in suspension or termination of the account, without notice or refund, and without prejudice to any legal action.
5. Intellectual Property
- The Platform, its structure, source code, interfaces, trademarks, logos and editorial content are the exclusive property of Mathieu Neumar ("Velyq") or its partners. No reproduction, representation, adaptation or exploitation, in whole or in part, is permitted without prior written consent.
- The User retains full ownership of the content they submit (CVs, cover letters, job descriptions, interview answers, etc.).
- In order to provide the Service, the User grants Velyq a non-exclusive, royalty-free and limited license to host, process and transmit this content, including to third-party AI providers, solely to the extent necessary to perform the requested features.
6. Offers and Prices (Sales Terms)
The Service is offered under the following plans:
- Free plan: access to basic features, subject to usage quotas;
- Premium plan: €9.99 per month (price inclusive of tax; VAT not applicable, Art. 293 B of the French Tax Code), granting access to all features under the conditions displayed at the time of order.
One-off offers (for example a pass or pay-as-you-go) may be proposed; where applicable, their conditions and prices will be specified at the time of order. The applicable prices are, in any event, those displayed on the Platform at the time the order is confirmed. Prices are shown in euros.
7. Order, Payment and Renewal
- The order is confirmed when the User validates their subscription and proceeds with payment. A summary is presented to them before validation.
- Payment is processed by our provider Stripe, via a secure connection. Velyq does not have access to full payment card data.
- The monthly subscription renews automatically, for successive one-month periods, until cancelled by the User. The price in force is charged at each renewal date.
- In the event of payment failure, access to paid features may be suspended until the situation is resolved.
8. Right of Withdrawal
In accordance with Article L221-18 of the French Consumer Code, the consumer Customer has a period of fourteen (14) days from the conclusion of the contract (subscription purchase) to exercise their right of withdrawal, without having to give reasons or incur any penalty. To do so, the Customer may send an unambiguous request by email to contact@velyq.com before this period expires.
Any refund will be made, where applicable, under the conditions provided by law, subject to Section 9 below regarding digital content and services.
9. Immediate Performance and Waiver of the Right of Withdrawal
The Service consists of the supply of digital content not provided on a tangible medium and of a digital service whose performance begins immediately after the order. Accordingly, in accordance with Article L221-28, 1° and 13°, of the French Consumer Code:
- By subscribing and requesting immediate access to the Service, the Customer expressly consents to performance beginning before the end of the 14-day withdrawal period;
- The Customer expressly acknowledges that they lose their right of withdrawal once the digital content has been fully supplied, or the digital service has been fully performed, where performance began after their prior express consent and acknowledgment of the loss of this right.
This consent and acknowledgment are obtained at the time of the order (checkbox or explicit confirmation). In the absence of such consent, the right of withdrawal under Section 8 applies in full. This waiver explains the absence of a refund after use of the Service, in compliance with the law.
10. Termination
- The User may cancel their subscription at any time from their personal account or by writing to contact@velyq.com.
- Cancellation takes effect at the end of the current subscription period: the User retains access to paid features until that date, after which the subscription is not renewed.
- No pro-rata refund is made for the current period already paid, subject to the consumer's statutory rights (in particular the right of withdrawal and legal guarantees).
- Velyq may terminate or suspend access in the event of the User's breach of these Terms.
11. Legal Guarantees
Independently of these Terms, the consumer Customer benefits as of right from the applicable legal guarantees, in particular the legal guarantee of conformity (Articles L217-1 et seq. of the French Consumer Code), including for digital content and services, as well as the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). These guarantees apply at no additional cost. To enforce them, the Customer may contact contact@velyq.com.
12. Mediation and Dispute Resolution
In accordance with Article L612-1 of the French Consumer Code, the consumer Customer has the right to use, free of charge, a consumer mediator to amicably resolve a dispute with Velyq, after first attempting to resolve it through a written complaint sent to contact@velyq.com.
- Consumer mediator: [to be completed — mediator to be subscribed before the first sale, for example CM2C or Medicys].
- European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.
Recourse to mediation is optional and available only for consumer disputes, under the conditions provided by law.
13. Liability
- The Service is provided "as is" and "as available". Velyq does not guarantee continuous and uninterrupted availability, and may temporarily suspend the Service for maintenance or updates.
- Content generated by artificial intelligence may contain errors, inaccuracies or omissions; it cannot replace the User's own judgment. Velyq does not guarantee the accuracy, completeness or fitness of this content for any particular purpose.
- The User remains solely responsible for their job applications, for the information they share with third parties, and for the decisions they make.
- Velyq cannot be held liable for indirect damages. To the extent permitted by law, Velyq's total liability is limited to the amounts actually paid by the Customer for the subscription over the last twelve (12) months. Nothing in these Terms limits Velyq's liability in the event of gross negligence, willful misconduct, or in cases where the law prohibits such limitation.
14. Personal Data
The processing of Users' personal data (including content processed by third-party AI providers) is described in our Privacy Policy, available on the Platform. Velyq acts in accordance with the GDPR and the French Data Protection Act.
15. Changes to the Terms and Prices
- Velyq reserves the right to modify these Terms and prices. Users are informed of substantial changes within a reasonable timeframe, by an appropriate means (notably by email or via the Platform).
- New prices and new conditions apply to orders and renewals taking place after they enter into force. A Customer who does not accept a price change may cancel their subscription before it takes effect, under the conditions of Section 10.
- The applicable Terms are those in force on the day of the order.
16. Governing Law and Jurisdiction
These Terms are governed by French law. In the event of a dispute, the parties will endeavor to find an amicable solution, where appropriate through mediation (Section 12), before any legal action. Failing amicable resolution, the French courts have jurisdiction, subject to the protective rules applicable to consumers. For any questions: contact@velyq.com.
